TICKET POLICY AND LEGAL DISCLAIMERS

TICKET POLICY

EACH TICKET PURCHASED IS A REVOCABLE LICENSE. LUMINOCITY RESERVES THE RIGHT TO REVOKE THE LICENSE TO ENTER AND/OR BE PRESENT AT THE EVENT PREMISES AT ANY TIME.

By use of the event ticket, the ticket purchaser and/or each applicable ticketholder (“you” or “Holder”) agrees that LuminoCity, Inc. (“LuminoCity”) shall have the unrestricted right and license to use their image, likeness, name, voice, comments or other proprietary or public rights and that of any minor accompanying ticket holder in any broadcast, telecast or photograph and/or video and/or audio sound recording taken in connection with the LuminoCity event (the “Event”), for all purposes, without compensation in accordance with the Media Release set forth below.

The Holder voluntarily assumes all risks incident to the event, including the risk of lost, stolen or damaged property, personal injury or death. LuminoCity may revoke this license and eject or refuse entry to the Event to the holder for violation of venue rules, illegal activity, misconduct or failure to comply with any and all security measures. The Holder acknowledges and agrees that any transactions that the Holder enters into with a vendor, merchant or other third party present at, or in attendance of the Event are solely between the Holder and that vendor, merchant or other party and LuminoCity has no liability or responsibility as to any such transaction.

LuminoCity reserves the right to implement certain security measures including, but not limited to hand-held metal detection and bag checks. Only small purses or bags will be admitted. No animals (w/ exception of service dogs), backpacks, banners, bottles, cans, containers of any kind, contraband, fireworks, GoPros, laptops, large bags, laser pointers, noisemakers, outside food and drink, oversized packages, projectiles, weapons, audio recording equipment, video cameras, professional cameras with lenses longer than 6″, tablets/iPads, school bags, sticks/poles/selfie sticks, or any other item(s) determined to be unacceptable by LuminoCity or the venue will be permitted (collectively, “Prohibited Items”). If any Prohibited Items are revealed during search, the Holder will be permitted to return to their vehicle with the item(s) or they can dispose of the item(s). The Event organizers and their agents will not store any personal belongings or items of any type.

The Holder voluntarily assumes all risk associated with the purchase of the Event ticket from anyone other than LuminoCity or its designated agents. Your ticket may not be used for advertising, promotion (including contests or sweepstakes), or other trade or commercial purposes without the express written consent of LuminoCity.

AMUSEMENT RIDES

As part of the LuminoCity festival you may participate in certain activities, including, without limitation amusement rides, games, and activities, which may pose a degree of risk and potential danger when engaging in such activities (collectively, “Activities”). You understand that the Activities all inherently involve risks and potential dangers and recognize the use of the Activities may result in accident, loss, damage, or physical injury including, but not limited to, minor injuries, broken bones, paralysis or death. You acknowledge you are not relying on LuminoCity to provide a list of all the possible risks and dangers that could potentially affect you, either in this Waiver or at any time, now or in the future. DO NOT RIDE OR PARTICIPATE IN ANY ACTIVITIES IF YOU ARE PREGNANT OR HAVE ANY MEDICAL ISSUES, INCLUDING, BUT NOT LIMITED TO, ANY NECK, BACK, BLOOD PRESSURE OR HEART CONDITIONS. 

YOU KNOWINGLY AND FREELY ASSUME ALL RISKS OF ANY NATURE, BOTH KNOWN AND UNKNOWN, FOR ANY DEATH, INJURY, OR OTHER DAMAGES, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES (as defined below) to you, your property, or the property of others which may in any way, whether foreseeable or not, arise out of the Activities and/or from the actions – specifically including negligent acts or omissions – of all persons involved either directly or indirectly in the Activities. You acknowledge that you FULLY APPRECIATE THESE DANGERS AND VOLUNTARILY ASSUME THESE RISKS and assume full responsibility for your participation. You willingly agree to comply with the stated and customary terms and conditions for participation. If, however, you observe any unusual significant hazard during your presence or participation, you will remove yourself from participation and bring such to the attention of Event staff immediately; and,

YOU HEREBY RELEASE, HOLD HARMLESS, AND COVENANT NOT TO SUE LUMINOCITY, LUMINOCITY, ITS BOARD, OFFICERS, INDEPENDENT CONTRACTORS, AFFILIATES, EMPLOYEES, REPRESENTATIVES, SUCCESSORS, AND ASSIGN OTHER PARTICIPANTS, SPONSORING AGENCIES, SPONSORS, ADVERTISERS, AND IF APPLICABLE, OWNERS AND LESSORS OF PREMISES USED TO CONDUCT THE EVENT (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, LOSS, OR DAMAGE TO PROPERTY WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW.

MEDIA RELEASE

By entering the Event venue, you will enter an area where photography, audio, and video recording may occur. You hereby grant permission to use your likeness, image, voice, and/or appearance as such may be embodied in any photos, video recordings, audiotapes, digital images, podcasts, social media posts, and the like, taken or created by or on behalf of LuminoCity or its employees, contractors sponsors, partners and/or representatives.

You irrevocably authorize LuminoCity to edit, alter, copy, exhibit, publish or distribute any photograph, audio and/or video using your likeness, image or voice for purposes of publicizing LuminoCity services and for any other related lawful purpose. These include, but are not limited to, LuminoCity’s website, social media, marketing materials, printed and digital newsletters videos, advertisements, news releases, and any promotional materials in any medium. 

In addition, you hereby waive the right to inspect or approve the finished product, including written or electronic copy, wherein your likeness appears. Additionally, you acknowledge that you will not receive any type of payment for the use of such images, video, likeness, etc. and waive any right to royalties or other compensation arising or related to the use of the photographs and/or videos. 

YOU HEREBY HOLD HARMLESS AND RELEASE AND FOREVER DISCHARGE LUMINOCITY, AND ITS SHAREHOLDERS, EMPLOYEES, CONTRACTORS, AGENTS AND REPRESENTATIVES FROM ANY AND ALL CLAIMS AND DEMANDS ARISING OUT OF OR IN CONNECTION WITH THE USE OF YOUR LIKENESS, IMAGE, VOICE AND/OR APPEARANCE, INCLUDING ANY AND ALL CLAIMS FOR INVASION OF PRIVACY, RIGHT OF PUBLICITY, MISAPPROPRIATION OR MISUSE OF IMAGE, AND/OR DEFAMATION.

BY PURCHASING AND/OR HOLDING A TICKET TO THE EVENT AND ATTENDING THE EVENT, YOU ACKNOWLEDGE AND AGREE TO THE ABOVE TERMS. YOU  UNDERSTAND THAT YOU ARE GIVING UP SUBSTANTIAL RIGHTS AND AGREE TO IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.  

You hereby represent that each Holder is at least eighteen (18) years old and fully competent to give consent, or Holder is the parent, guardian, or agent acting on behalf of any minors accompanying Holder, and provide such consent on such minor(s) behalf; That Holder has been sufficiently informed of the risks involved and gives their voluntary consent and with full intention to be bound by the same, and free from any inducement or representation. This release shall be binding upon Holder, its heirs, legal representatives, and assigns. This agreement is being made and entered into under the laws of the State of New York and shall be governed and interpreted in accordance with the laws of said state.
